Ombudsman investigate planning system - has there been injustice to an individual or group?

Dear Katherine,
Thank you for your help.  I feel that this advice is particularly helpful to the owners of a thriving cafe/restaurant business which is directly opposite the entrance to the waste site, approximately 30 yards away.  Their business will be badly hit as a lot of dining takes place in the open air.  Customers would not like to see or smell the 185 lorry movements each day, I am sure, and I doubt whether the business would survive.  KCC does not seem to care about this.

Dear Mrs Turton,

Thank you for your email. Unfortunately the Ombudsman cannot investigate the entire planning system of a council, we can however investigate whether or not the council has appropriately approved a specific planning application as long as the approval causes an injustice to an individual or group of people. For example if a development has been approved that would over-look an individuals property they could make a complaint if they feel the council failed to consider the consequences of the approval.

If you would like the Ombudsman to investigate the approval of a specific application as it has caused you a personal injustice you will need to complete the councils own formal complaints process before sending the complaint to the Ombudsman.
