FLY POSTING IN OUR COMMUNITIES

Dear Residents,

Our Association has been notified by Shepway District Council of a spate of fly posting in and around our communities informing residents of a Demonstration/Rally against the over development of our areas. 
Despite our Association instructing residents, via email (19.11.16) to observe the SDC protocol when displaying posters, it appears that there are members within our communities that, for one reason or another haven't read the said email. However, it is understandable that the level of anger and opposition to the proposed New town, Lorry Park and Princes Parade has led to a disregard of SDC rules as outlined by Ms Jyotsna Leney in documentation set out below.
We would respectfully ask the perpetrator to remove the posters within 3 days to bring us all in line with the Shepway ruling.

The Council has recently been notified of fly-posting in the district area promoting a "Rally to Protect our Countryside" for Saturday 22nd April 2017 (copy attached). 
Locations of the Flyposting include:

Post at Palm Tree Way, Lyminge
Post at the end of Mayfield Road where it joins Station Road in Lyminge
Post adjacent to the postbox/telephone box in Swan Lane by Greenfield
Swan Lane, Sellindge (above post box attached to column)
Swan Lane Sellindge – telegraph pole
Woodland Road, Lyminge – telegraph pole

Kent County Council Highways have also been informed of the land being fly-posted.
Fly-posting is a crime. Any person who displays an advertisement in contravention of the Town and Country Planning (Control of Advertisements) (England) Regulations 2007 ("COA Regulations") is guilty of a criminal offence and will be liable on summary conviction to a fine.
 The Council operates a zero-tolerance policy approach to fly-posting, generally regarded as any advertising material displayed on private and/or public property without the consent of the owner that does not meet the requirements of the COA Regulations. 

There are many problems associated with fly posting, including:

·         Fly posting is an illegal activity which is not only unsightly, but also gives an impression of neglect and can attract other forms of vandalism and anti-social behaviour leading to the decline of an area.
·         It creates litter which spoils the clean and green environment the Council is seeking to maintain. 
·         It can obscure important traffic signs or create an obstruction to pedestrians and/or motorists.
·       It is a very cheap form of advertising which puts those who advertise legally at an unfair disadvantage.
It is a drain on local authority resources and an unwelcome expense for other landowners who are required to remove the advertisements from their property.
·         It can cause injury if a placard or heavier-type sign dislodges from its fixings.

As the Local Planning Authority, Shepway District Council is responsible for the day-to-day operation of the advertisement control system. Those wishing to advertise should always contact the Council's Planning Team for advice.

If there is evidence or a witness for a case of fly-posting, the Council can investigate and prosecute offenders. As the fly-posting has identified the person who displayed it or caused it to be displayed, you are requested to remove the fly-posting advertising the "Rally to Protect our Countryside" within 3 days of the date of this letter, ensuring you do not display posters this way or encourage others to do so.
If the fly-posting is not removed, the Council will exercise its powers to remove or obliterate the advertisements and can seek to recover the costs that we have reasonably incurred in doing so.
Where possible, the Council fully supports the promotion of activities and events, which enrich the lives of local communities across the district. However, we are always mindful to ensure this is undertaken consistently and lawfully.
